PRIVACY POLICY

This Privacy Policy (hereinafter referred to as the “Policy” or “Privacy Policy”) has been developed in accordance with the requirements of the Constitution of Ukraine, the Law of Ukraine “On Personal Data Protection” dated 01.06.2010 No. 2287-VI, other current regulatory acts of Ukraine that regulate the protection of personal data and international regulatory legal acts ratified in Ukraine that regulate legal relations related to the collection, processing, storage of personal data, as well as the right of citizens to non-interference in their private lives and the right to self-expression. The law (including international law), national and international regulatory legal acts that regulate the protection of personal data of residents of such countries also apply to legal relations that arise in the Fund in connection with the processing of personal data of residents of foreign jurisdictions. The Policy is concluded between the visitor (hereinafter referred to as “You” or “User”) and the Charitable Organization “Charitable Foundation “Sky of Victory” (hereinafter referred to as “We” or “Fund”) regarding the use of the website: https://neboperemogy.com.ua/ (hereinafter referred to as the “Site”). Your provision/posting of information on the Site constitutes your agreement with the content of this Privacy Policy and means that you grant your permission for Us to collect, use and disclose/distribute information that identifies You in accordance with this Privacy Policy. If You do not agree with the terms of this Privacy Policy, DO NOT send Us any information and immediately stop using the Site. The owner of personal data processed in connection with visiting/using the Site options is the Foundation. The Foundation has the right to entrust the processing of personal data in whole or in part to third parties on the basis of a contract concluded in accordance with the requirements of applicable law. Please read this page carefully, as the information provided on it is important for you as a User of the site.

DEFINITION OF TERMS

1.1 This Privacy Policy uses the following terms:

1.1.1. “Administration of the Foundation’s website (hereinafter referred to as “Site Administration”) – employees and/or volunteers of the Foundation authorized to manage the website, acting on behalf of the Foundation, who organize the processing of personal data, and also determine the purposes of processing personal data, the composition of personal data subject to processing, actions or operations performed with personal data.

1.1.2. "Personal data" - any information that relates directly or indirectly to a specific or identifiable natural person (personal data subject).

1.1.3. "Personal data subject" - an individual whose personal data is processed.

1.1.4. "Processing of personal data" - any action (operation) or set of actions (operations) performed with the use of automation tools or without the use of such tools with personal data, including collection, recording, systematization, accumulation, storage, clarification (update, change), extraction, use, transfer (distribution, provision, access), depersonalization, blocking, deletion, destruction of personal data.

1.1.5. "Confidentiality of personal data" - a requirement that must be observed by the Site Administrator or other persons who have access to personal data not to allow their dissemination without the consent of the personal data subject or the presence of another legal basis.

1.1.6. "Third party" - any person, except for the subject of personal data, the controller or processor of personal data.

1.1.7. "Site User" - a person who has access to the Site via the Internet and uses the Site.

1.1.8. "Cookies" are small pieces of data that are stored in the browser of a device (computer, mobile phone, etc.) after visiting the Site, and which the Site transfers to the browser.

1.1.9. "Consent" - a voluntary expression of will of an individual (provided that he is informed) to grant permission for the processing of his personal data in accordance with the formulated purpose of their processing, expressed in a form that allows to conclude that consent has been granted.

1.1.10. "Personal database" - a named set of organized personal data in electronic form and/or in the form of personal data files;

1.1.11. "IP address" - a unique network address of a node in a computer network, built using the IP protocol.

2. SUBJECT OF THE PRIVACY POLICY

2.1. The Site Administrator collects your Personal Data only if you have voluntarily provided the relevant information or have clearly expressed your consent to its provision and/or use. The User gives his/her consent to the Site Administration to process the information received, including collection, systematization, accumulation, storage, clarification (update, correction), use, distribution, depersonalization, blocking, destruction of personal data, for the purpose of measures aimed at forming a personal data base.

2.2.3. Secondary (technical) data. We do not directly collect information about your payment methods, such as bank cards, etc. If you wish to make a charitable contribution through the Site, you will be redirected to the website of a third party - a payment operator, through which you can make such a payment, your payment details will be provided not to the Foundation, but to the operator of such payment operator. Please note that your data will be processed by such third party in accordance with its privacy policy or other agreement concluded with you.

2.2.6. Personal data of children. We do not wish to collect information about visitors who have not reached the age of 18. We ask Users who have not reached the age of 18 (hereinafter referred to as a child) not to send any personal information to Our email address. If the parents or other legal representatives of the child discover that the child has provided certain information to the Site and believe that such data should be destroyed, upon their request We will take measures to delete such information.

3. PURPOSES OF COLLECTING AND PROCESSING PERSONAL DATA

4. CATEGORIES OF DATA COLLECTED

4.1. The categories of Personal Data collected by the Site (either independently or through third parties) include: Cookies and Data on the use of network resources. 4.2. Personal Data may be provided by the User independently or may be automatically collected by the Site when using it. 4.3. Unless otherwise specified, the Site uses cookies (or other tracking tools) to identify users and remember the global settings they set solely for the purpose of providing the service requested by the User. 4.4. 5. METHODS AND TERMS OF PROCESSING PERSONAL DATA

5.1. 7. RESPONSIBILITY OF THE PARTIES

7.1. The Fund is responsible for the intentional disclosure of the User's Personal Data in accordance with applicable law, except for the cases provided for in clauses 5.3, 6.1. and 7.2. of this Privacy Policy.

7.2. In the event of loss or disclosure of Personal Data, the Fund is not liable if the confidential information:

7.2.1. Became public domain before its loss or disclosure.

7.2.2. Was received from a third party before its receipt by the Site Administration.

7.2.3. Was obtained by third parties through unauthorized access to the site's files.

7.2.4. Was disclosed with the consent of the User.

8. DISPUTE RESOLUTION

8.1. Before filing a lawsuit in court in disputes arising from the relationship between the Site User and the Foundation, it is mandatory to submit a claim (a written proposal for voluntary settlement of the dispute).

8.2. The recipient of the claim shall, within 30 calendar days from the date of receipt of the claim, notify the claimant in writing of the results of the claim review.

8.3. If no agreement is reached, the dispute will be referred to a judicial authority in accordance with applicable law.

8.4. Current legislation applies to this Privacy Policy and the relationship between the User and the Website Administration.

9.1.
